Periodic Review of Existing Rules

NCGS §150B-21.3A requires state agencies to review existing rules on a 10-year review cycle.

Pursuant to NCGS §150-21.3A (c), the Division is requried to conduct an analysis of each existing rule and make an initial determination as to whether the rule is necessary or unnecessary.

  • Necessary rule - Means any rule other than an unnecessary rule.
  • Unnecessary rule - Means a rule that the agency determines to be obsolete, redundant, or otherwise not needed.

Pursuant to the NCGS §150B-21.3A (c)(1), the Division has posted the results of the initial determination here. The Division invites the public to comment on the rules and the agency's initial determination.

Comments will be accepted by e-mail at rules@nccud.nc.gov.

All comments are a public record and will be submitted to the Rules Review Commission.
